Chapter 5

Early Battles- Trenton and Princeton, Washington crosses the Delaware on Christmas Eve and they surprise the British and Hessians; they were partying. Washington and other forces after the fight have to run away because the British come after them . This was not so much a big win but more of a morale booster. Two skirmishes that are small victories.

A turning point comes, Saratoga, which was a significant military victory. The Americans wanted help from the French but the French wouldn't help because the Americans were not winning. Until the battle of Saratoga, the French would not help, but because the Americans won the French start to support the Americans. Benjamin Franklin was in France helping to convince the French to join. The treaty between the Americans and French expresses that they would be trading partners and have a permanent alliance.

Richard Henry Lee proposed independence in the 2nd continental congress where they become states and not colonies anymore.

they agreed that every state needed a written constitution. The states moved toward popular soveirgnty, the idea that all of the governments power comes from the people. Most of the states have a two house legislature. All states made the legislature branch the most powerful. There were a variety of ways for choosing the people that were in the upper house. Most states wrote in a Bill opf Rights.

VA- constitution set up 3 branches, legislature dominant, governor was chosen by the legislature, governor cousel and judges were also chosen by the legislature. The governor did not have any veto power. The lower house stood for election every year whereas the upper house was every 4 years.

Thomas Jefferson writes the Va Declaration of Rights which granted to Virginia citizens life, liberty, property, and pursuit of happiness. Also guaranteed trials by juries and due process of law. Also included a minor law for freedom of religion, will be expressed more later on.
2nd Continental Congress was the government during the war. They created the Articles of Confederation. All 13 states agreeing to cooperate on certain things but the states are still in control of their own affairs. There was no judicial branch, had a strong legislature, and not a big executive branch.

Legislature has no power over Western land claims. The National government would go to the states for money, Congress could not tax or regulate trade. There was no cheif executive either. All of the 13 states had to agree to amend laws. The National government was weak.
